Welcome to RethinkChurch.org, an official outreach ministry of The United Methodist Church. RethinkChurch.org is operated by United Methodist Communications (“UMCom”). For the purposes of these Terms of Use, RethinkChurch.org, its companion Facebook fan page, and its related micro-sites are collectively referred to as the “Website.”

The Website is designed to provide a social platform to anyone interested in exploring the works of The United Methodist Church. We invite you to enjoy the features of our Website. To assist in the lawful, orderly and successful operation of our Website, we must require that you abide by our Terms of Use. Please note that failure to abide by these Terms of Use may result in immediate termination of your access to our Website.

General Rules

1. Please do not copy others’ property without permission. Our content, images, videos, and trademarks and those of others posted on our Website may not be copied or used without permission of the owner. Any authorized retransmission, redistribution, or rebroadcast of our content must include appropriate attribution to RethinkChurch.org.

2. Post only legal content. When posting content to our Website, such as text, photos or videos, please make sure you have permission from the content owner and that the content does not violate any laws or rights of others.

3. Respect the privacy of others. Make sure any content you post to our Website does not invade the privacy of others. You should be especially mindful of this rule with photos and videos of others and make sure you have permission before posting.

4. A special word about photos and videos of children. Photos and videos of children and other personal details about children may be posted only with the permission of their parents or guardians.

5. Treat other users with respect. Please avoid impersonation, harassment, intimidation or abuse of other users.

6. Use at your own risk. Your use of our Website is at your own risk, and UMCom is not responsible for the security of personal information you choose to share on our public forums.

7. We may remove content or terminate access. We reserve the right to remove any content posted on our Website or modify or terminate your access to the Website for any reason.

Website Terms of Use  

RethinkChurch.org is operated by United Methodist Communications (“UMCom”). For the purposes of these Terms of Use, RethinkChurch.org, its companion Facebook fan page, and its related micro-sites are collectively referred to as the “Website.” By browsing, accessing, linking, using, signing into your account, registering with and/or downloading information from the Website, you agree to these Terms of Use. If you are using the Website on behalf of another person, you represent that you are authorized to accept these Terms of Use on that person’s behalf.

UMCom reserves the right, at any time, to modify, alter, or update these Terms of Use. Modifications shall become effective immediately on being posted on the Website and/or re-issuance to Website profile holders at their next sign-in. Your continued use of the Website after amendments are posted constitutes an acknowledgement and acceptance of the Terms of Use and its modifications. Except as provided in this paragraph, these Terms of Use may not be amended.

 

1. Authorized Users. If you are under the age of 13, you may not use this Website. This Website is not intended or designed to attract children under the age of 13. UMCom does not collect personally identifiable information from any person UMCom actually knows is a child under the age of 13.

2. Accounts. You may have the option to create an account and establish a “user profile” to participate in certain features of the Website. If you are under the age of 13, you are not permitted to register as a user or otherwise submit personal information to UMCom. Users must affirm that they are at least 13 years old to create an account. If you create an account, you are responsible for maintaining your profile and utilizing the settings available to protect the confidentiality of your profile user name, password and all other personal information. You are responsible for all uses of your account, whether or not actually or expressly authorized by you. You agree to provide, maintain and update true, accurate, current, and complete information about yourself in the registration process. You shall not impersonate any person or entity or misrepresent your identity or affiliation with any person or entity, including using another person’s username, password or other account information, or another person’s name, likeness, voice, image or photograph. You also agree to promptly notify UMCom with any questions of any unauthorized use of your username, password, other account information, or any other breach of security that you become aware of involving or relating to the Website.

3. Intellectual Property/Copyright. Unless otherwise noted, all content on the Website, including, without limitation, trade dress, trademarks, service marks, software, source code, object code, website design, text, graphics, button icons, files, interfaces, drawings, designs, illustrations, images, photographs, video clips, music and sounds, sound recordings, lyrics, the word and logo marks RETHINK CHURCH®, UNITED METHODIST COMMUNICATIONS®, and THE UNITED METHODIST CHURCH®, and other materials, and the selection and arrangements thereof (collectively, the “Website Content”), is the property of UMCom and/or its affiliates or licensors. UMCom reserves all rights in such Website Content. Subject to these Terms of Use, UMCom grants you a non-exclusive, non-transferable, limited right to access, use and view this Website and the “Website Content” solely for your own personal, non-commercial use, provided, however, that you may not, nor may you allow others to, directly or indirectly publish, sell, license, lease, rent, reproduce, modify or attempt to modify or create derivative works from the Website Content in any way or reproduce or publicly display, perform, transmit or distribute or otherwise use the Website Content for any public or commercial purpose, including, without limitation, use of the Website Content on any other website or in any environment of networked computers, or transfer the Website Content to any other person without the prior written explicit consent of UMCom. Any authorized retransmission, redistribution, or rebroadcast of Website Content must include appropriate attribution to RethinkChurch.org. Except as expressly provided herein, no license to use or reproduce the Website Content is given to you, and all intellectual-property rights therein are expressly reserved. Systematic retrieval of data or other Website Content from this Website to create or compile, directly or indirectly, a collection, compilation, database or directory without express prior written permission from UMCom is prohibited. You shall not sublicense, assign, or transfer the license granted to you under these Terms of Use. Any attempted sublicense, assignment, or transfer of any of your rights, duties, or obligations contained in these Terms of Use shall be void. You may not remove, obliterate, or cancel from view any copyright, trademark, confidentiality or other proprietary notice, mark or legend appearing on this Website. You may not reverse-engineer, decompile, translate, adapt or dissemble the Website or the Website Content. 4. Warranty and Indemnification. You warrant and represent that all content added to the Website by or at the behest of you or your agents or representatives, including, without limitation, music, videos, sounds, lyrics, messages, text, illustrations, files, images, graphics, photos, comments, information, content, and/or other materials (“User Content”) is free of third-party claims and does not infringe the rights of any third party. By adding or uploading User Content, you warrant and represent that you own or otherwise control all rights to the User Content. You agree to indemnify, defend and hold harmless UMCom and its parents, subsidiaries, affiliates, members, officers, directors, employees, consultants, agents, representatives, sponsors and service providers from any claim, demand, liability, loss, damages, or cause of action, including attorneys’ fees and costs, made by any third party due to or arising out of your breach of the warranties and representations herein, your use of the Website, the violation of these Terms of Use, or infringement by you, or other user of the Website using your computer, of any intellectual property or any other right of any person or entity. You will cooperate as fully as reasonably required in the defense of any claim. UMCom reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you will not in any event settle any such matter without UMCom’s written consent.

5. User Content. UMCom is not responsible or liable for any User Content on the Website. User Content does not necessarily express the views of UMCom. UMCom does not guarantee that it will edit or delete User Content. UMCom has the right, but not the obligation, to monitor User Content. UMCom reserves the right to reveal your identity (or whatever information UMCom knows about you) if a complaint or legal action arises from your behavior. Unless otherwise specified, UMCom does not claim ownership of the User Content on the Website. You acknowledge that UMCom is not responsible for the accuracy of any User Content and that you and not UMCom are solely responsible for any User Content you post or upload to the Website. It is your responsibility to evaluate the accuracy, timeliness, completeness, or usefulness of the content on this Website. Under no circumstances will UMCom be liable for any loss or damage caused by your reliance on any content on the Website. By posting or uploading User Content to the Website, you are granting UMCom a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use the User Content in connection with the Website. Information and opinions expressed in public forums or other interactive communications by third parties are not necessarily those of UMCom.

7. Compliance with Laws and Prohibited Uses. You assume all knowledge of applicable law and are responsible for compliance with all such laws. You may not use the Website in any way that violates applicable local, state, federal, or international laws, regulations, or other government requirements, including, without limitation, laws or regulations designed to protect minors. • Violates or infringes on the rights of others, including, without limitation, any copyright, trademark, patent, trade secret, moral right or other intellectual property, personal, contractual, proprietary or other third-party right of UMCom or any other person or entity;

• Impersonates another, including, without limitation, the Website webmaster, forum leader, guide or host;

• Is unlawful, false, threatening, harmful, intimidating, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, pornographic, sexually explicit, lewd, filthy, excessively violent, hateful, harassing or racially, ethnically, or otherwise objectionable within the sole discretion of UMCom;

• Is an advertisement, product or service offering, promotional material, chain letter, junk mail, pyramid scheme, or “spam” or other form of solicitation of any kind, including, without limitation, links intended to divert traffic to drive unrelated off-site sales;

• Includes personal information such as messages that identify phone numbers, social security numbers, account numbers, addresses, or employer references; • Discloses any personal identifying information relating to or images or video of a child under age 18 without consent of a parent or guardian;

• Contains a formula, instruction, or advice that could cause harm or injury;

• Is or can be used to copy, change, prepare derivative works of, edit, rewrite, save or alter in any way any content available or displayed on the Website; or

• Would result in UMCom having any obligation or liability to any party.

You shall not:

• Intentionally upload, post, link to, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any software, computer/tablet/phone or hardware on telecommunications equipment;

• Collect personal data about other users for commercial or unlawful purposes;

• Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Website unless otherwise expressly permitted by UMCom;

• Disrupt the normal flow of dialogue, or otherwise act in a manner that negatively affects other users’ ability to engage in real-time exchanges; or

• Interfere with or disrupt the Website or servers or networks connected to the Website, or disobey any requirements, procedures, policies or regulations of networks connected to the Website. UMCom reserves the right to immediately refuse service to you for violation of this section or any of these Terms of Use.

8. Not Professional Advice. The content on the Website is provided for informational purposes only, and should not be construed as advice. The content is not intended to, and does not, constitute legal or professional advice, and may not be used for such purposes.

9. Submission of Information. Although UMCom may provide certain security in an effort to protect the electronic transmission of certain information that you submit to UMCom through this Website, UMCom does not guarantee the security of any information transmitted to or from this Website, including to or from any third-party websites linked to this Website. Submission of any financial (e.g. credit card) or other information to this Website or to any third-party websites linked to this Website is entirely at your own risk and responsibility.

10. Privacy Policy. UMCom respects your privacy and will handle your personal information pursuant to UMCom’s Privacy Policy. By using the Website, you consent to the collection and use of personal information submitted by you in accordance with the Privacy Policy.

11. Recommended Best Practices for Protection of Minors’ Information. Although UMCom cannot guarantee the confidentiality, security and integrity of information maintained on the Website given the nature of the Internet, UMCom has established and follows recommended best practices to endeavor to protect photographs and information on minors on the Website. 12. Denial of Access UMCom, for any reason and at its sole discretion, may modify, disable and/or terminate your access to this Website or your user account, with or without notice, without liability to you, any other user or any third party.

13. Third-Party Sites. The Website may include links or provide you with access to other sites or content on the Internet that are owned, operated, and/or maintained by third parties. You acknowledge that UMCom is not responsible for the availability of, or the content located on or through, any third-party site and that your use of these third-party sites is at your own risk and that it is your responsibility to take all protective measures to guard against viruses and other destructive elements. UMCom is not responsible for the content, operation or privacy practices of these other websites, nor does it operate, control, or endorse the content found on these third-party websites. UMCom will in good faith endeavor to provide uninterrupted service to the Website, but you acknowledge and accept that UMCom does not guarantee continuous, uninterrupted or secure access to the Website, and operation of the Website may be interfered with or adversely affected by numerous factors or circumstances outside of UMCom’s control. Any legal issues arising from or related to your use of the Website shall be construed in accordance with, and all questions with respect thereto shall be determined by, the laws of the State of Tennessee applicable to contracts entered into and wholly to be performed within Tennessee. The state and federal courts of Davidson County, Tennessee, shall be the exclusive forum and venue to resolve disputes arising out of or relating to these Terms of Use or the use of or visit to the Website. By using the Website, and thereby agreeing to these Terms of Use, you consent to personal jurisdiction and venue in the state and federal courts in Davidson County, Tennessee, with respect to all such disputes. UMCom makes no representation that the Website is appropriate, legal or available for use in other locations. Accordingly, if you choose to use the Website, you agree to do so subject to the internal laws of the State of Tennessee.

19. Other Terms. These Terms of Use will inure to the benefit of UMCom’s successors, assigns and licensees. If any provision of these Terms of Use shall be unlawful, void, or unenforceable for any reason, the other provisions (and any partially enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. These Terms of Use shall apply in addition to, and shall not be superseded by, any other written agreement between UMCom and you in relation to the Website. UMCom’s failure to insist on or enforce strict performance of any provision of these Terms of Use shall not be construed as a waiver of any provision or right. The Privacy Policy and the Intellectual Property Policy are binding parts of these Terms of Use, and together with these Terms of Use constitute the entire agreement between UMCom and you with respect to your use of this Website. Terms of Sale or Donation

These Sales and Donation Terms and Conditions apply to any and all transactions, including, without limitation, your monetary donations and gifts, including those submitted pursuant to our Alternative Giving program (collectively, “Donations”), order and purchase of products and/or event registration (collectively, the “Products”) through this Website, which is operated by United Methodist Communications (“UMCom”).  By donating, placing an order and/or making a purchase through the Website, you acknowledge that you have read, accepted and agreed to be bound by these Terms and Conditions and shall comply with all applicable laws and regulations including U.S. export and re-export control laws and regulations.  These Terms and Conditions apply unless you have signed a separate purchase agreement with UMCom.  These Terms and Conditions are subject to modification without prior written notice at any time in UMCom’s sole discretion.

1.  Price and Payment Terms

Pricing is subject to change without notice.  UMCom reserves the right to limit quantities.  Prices displayed on this Website are subject to final approval at the time of order fulfillment.  Your total price or cost incurred for any transaction involving Donations or Products will be stated on your purchase receipt.  Terms of payment are within UMCom’s sole discretion and, unless UMCom agrees otherwise in writing, payment must be received by UMCom prior to UMCom’s acceptance of an order.  Payments must be made by credit card (Visa or MasterCard), debit card (issued by Visa or MasterCard) or some other prearranged payment method, unless credit terms have been agreed to by UMCom.  Prices are based on U.S. currency. You agree to pay all fees, shipping charges, and taxes, if applicable.  Orders are not binding on UMCom until accepted by UMCom, and UMCom reserves the right to decline the acceptance of any order, including, without limitation, in the event the price of the Product is a mistake.  Any price quotations given by UMCom will be valid for the period stated on the quotation.  Prices advertised do not include shipping and handling or applicable sales taxes, which will be added to the price you pay, unless you provide UMCom with a valid and correct tax exemption certificate.

2.  Taxes

In states where UMCom has no physical presence, UMCom is not required to collect and remit sales tax for purchases through this Website.  Many states, however, require that their residents file a sales or use tax return for items purchased on this Website.  For purchases where sales tax is applicable you will see the tax calculated on the checkout page before you are asked to confirm the purchase.  UMCom uses reasonable commercial efforts to calculate and remit the correct amount of tax required on each taxable purchase, but UMCom does not guarantee the accuracy of the amount of the tax it represents to you as the tax owed.  In consideration of UMCom’s allowing you to use and access this Website and collecting and remitting taxes required on your purchases, you hereby waive your right to claim that the tax collected on any purchase is incorrect in any respect, and you agree to hold UMCom and its officers, directors, affiliates, parents, subsidiaries, employees, agents and representatives harmless for any harm or other damages you may incur as a result of any error by UMCom in calculating the taxes you owe for your purchases.

3.  Shipping and Title

UMCom will arrange shipping of any Product ordered to your address.  Title to the Product passes to you upon delivery to the carrier, and risk of loss passes to you on delivery to your address.  The costs of shipping and handling will be shown on your purchase receipt.  UMCom will inform you of estimated shipment dates.  All Products will be shipped within thirty (30) days.  If, for any reason, a Product cannot be shipped within thirty (30) days, UMCom will notify you of the delayed shipment.  If you do not consent to the delayed shipment, UMCom will promptly refund all money paid by you for the unshipped merchandise.

4.  Inspection of Products upon Receipt

You must examine the Products when you receive them.  If any item is damaged or missing, you must notify UMCom immediately.  UMCom will not consider any claim for damaged or missing items more than thirty (30) days from the date of delivery.

5.  Products Offered

UMCom may revise and discontinue Products at any time.  UMCom will ship you Products that have the functionality and performance of the Products you ordered, but changes between what is shipped and what is described in a specification sheet or catalog are possible.  Product availability is subject to change without notice.  UMCom reserves the right to limit quantities.  UMCom attempts to be accurate in its descriptions of all Products.  UMCom does not warrant, however, that descriptions of Products or other content on this Website are accurate, complete, reliable, current or free from errors or omissions.  Textures, finishes, colors, patterns, sizes, and other visual features of Products might display differently on your computer monitor than the items appear in hand.  Images are shown for representational purposes only.  If a Product offered by UMCom is not as described, your sole remedy is to return it in unused condition. 

6.  Your Information

When you place an order for Products or submit a Donation through this Website, you will be asked to supply certain information applicable to such transaction, including, without limitation, credit card and other information. You understand that any such information will be treated by UMCom in the manner described in its Privacy Policy.  You agree that all information that you provide in connection with your order will be accurate, current and complete.  Transactions involving the sale or purchase of registration for events and/or the making of Donations generally, may be regulated by certain state, county and city laws or regulations.  You acknowledge that complying with all laws, including federal and state tax laws, is your responsibility, and YOU AGREE NOT TO HOLD UMCOM OR ITS PARENTS, SUBSIDIARIES, AFFILIATED ENTITIES, AGENTS, REPRESENTATIVES, OFFICERS, DIRECTORS, OWNERS OR EMPLOYEES LIABLE FOR YOUR FAILURE TO COMPLY WITH ANY LAW OR ANY FAILURE BY UMCOM TO NOTIFY YOU OF, OR PROPERLY APPLY, ANY LAW.  UMCOM MAY PROVIDE LAW ENFORCEMENT WITH ALL INFORMATION YOU SUBMIT TO UMCOM TO ASSIST IN ANY INVESTIGATION OR PROSECUTION IT MAY CONDUCT.  You grant UMCOM the right to provide any information you submit to third parties for purposes of facilitating the completion of purchases initiated by you or on your behalf.  Verification of information may be required prior to the acknowledgment or completion of any purchases or transactions.

7.  Events

No refunds or exchanges are available for event registration fees.  Event date and time, location, sponsor, and beneficiaries are subject to change. Event registration is valid only for the event for which a confirmation invoice is issued.  If you do not receive a confirmation invoice (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with UMCom whether or not your registration has been processed.  UMCom will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.  

8.  Return Policies and Exchanges

If you purchased a Product directly from UMCom, with the exception of event registrations, you may return it to UMCom up to thirty (30) days from the date of the invoice for a complete refund of the purchase price.  As specified above, no refunds or exchanges are available for event registration fees.  To return a Product, you must call UMCom Customer Service at (615) 742-5491 to receive a Return Authorization Number.  You must ship the Product to UMCom in its original packaging, prepay shipping charges and insure the shipment or accept the risk of loss or damage during shipment.  Returned Products must be in “as-new” condition, and all of the manuals, power cables and other items, if originally included with a Product, must be returned with the Products.  Any returned Product shipped C.O.D., or without a Return Authorization Number visible on the exterior of the carton, may be refused by UMCom.  From time to time, UMCom may, in its sole discretion, exchange Products or portions of a Product.  Any exchanges will be made in accordance with UMCom’s exchange policies in effect on the date of the exchange. 

9.  Not for Resale

You agree and represent that, in the event you purchase a Product, you are doing so for your own internal use only, and not for resale. 

10. Donations

UMCom retains complete control over the use and distribution of Donations in furtherance of its mission.  All Donations are final and non-refundable.  A service fee may or may not be applicable to your donation.  Any such fee will be shown on your purchase receipt and/or confirmation invoice.  All Donations are tax-deductible.  UMCom is not an accounting, taxation or financial advisor, and you should not rely on information on this Website to determine the accounting, tax or financial consequences of making a Donation.  Please consult your accounting, taxation or financial advisor for specific questions about your Donation.
